Indiana Truck Accident Lawyers Represent Those Injured in Collisions with Commercial Trucks

Interstate carriers are required to follow the U.S. Federal Motor Carrier Safety Administration (FMCSA) rules concerning inspecting and maintaining their trucks. One of the most fundamental FMCSA rules include:

    • Commercial vehicles in danger of breaking down or causing an accident are not allowed on the road.
    • Drivers must conduct pre-trip and post-trip inspections of their trucks and trailers. When a driver conducts a pre-trip inspection, the prior driver’s trip must be reviewed, including the post-trip inspection results. If any repairs were required at the end of the last trip, the next driver must confirm that they were completed.
    • At the end of each workday, a truck driver must complete a daily trip report and provide it to the fleet company. Any defects noted must be included in the report.
    • Trucking companies are required to methodically inspect, maintain, and repair its trucks and keep them safe, and reporting its findings. The FMCSA requires the inspection of certain components and parts, including brakes, frame, fuel system, mirrors, steering components, suspension, tires, and windshield wipers.
    • If a truck is expected to break down or trigger an accident, it must display an out-of-service sticker until repairs have been completed.
    • Trucking companies must keep active fleet inspection and maintenance records for one year. After a truck is no longer active, the records should be available for six months.
